Allstate Termite & Pest Control, Inc does not guarantee that any particular  treatment, product, recommendation, or method will eliminate a particular pest,  prevent future infestations, or produce a particular result. 

Where professional pest-control services are offered, the specific terms of the  applicable service agreement or work authorization will control in the event of a  conflict with these general Terms.

ALLSTATE TERMITE & PEST CONTROL, INC DISCLAIMS ALL  WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF  MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE,  NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE  OF DEALING OR USAGE OF TRADE. 

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED,  SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL  COMPONENTS. 

  1. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLSTATE TERMITE  & PEST CONTROL, INC AND ITS OWNERS, OFFICERS, EMPLOYEES,  CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL  NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,  CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT 

OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE  WEBSITE, PRODUCTS, SERVICES, OR CONTENT. 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLSTATE TERMITE  & PEST CONTROL, INC TOTAL LIABILITY ARISING OUT OF OR  RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE  GREATER OF (A) THE AMOUNT YOU PAID TO ALLSTATE TERMITE &  PEST CONTROL, INC FOR THE PARTICULAR PRODUCT OR SERVICE  GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE  EVENT GIVING RISE TO THE CLAIM OR (B) $100. 

Nothing in these Terms is intended to exclude or limit liability that cannot legally  be excluded or limited under applicable law.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold  harmless Allstate Termite & Pest Control, Inc and its owners, officers, employees,  contractors, agents, affiliates, and service providers from and against claims,  liabilities, damages, losses, costs, and expenses (including reasonable attorneys’  fees) arising out of or relating to: 

  • Your violation of these Terms; 
  • Your misuse of the Website; 
  • Your violation of applicable law or the rights of another person; or • Content you submit to the Website.

Before filing a lawsuit concerning a dispute arising from these Terms or the  Website, the parties agree to make a good-faith effort to resolve the dispute  informally.

Important: Any arbitration requirement, class-action waiver, or mandatory pre suit procedure should be added only after it has been reviewed for enforceability  and tailored to the way Allstate Termite & Pest Control, Inc operates.
